  1. Terms and phrases

    Terms of service refer to Terms and Conditions, which may be amended from time to time.

    Specific meaning in this document:

    1. “content” means all information (examples are data files, text, software, any music, video or image files) which the user may have access to as through your use of the Service;
    2. “access” can refer to visiting the website; loading of content in a software browser or viewers or players which co-opTV specifically provides or enables; access also includes content through use of mobile applications, mobile phone or any software or application or device which engages with the Service;
    3. “protected property” means the content of all patents, copyrights, designs, trademarks, models, brands, names, trade names, graphics, icons, specific knowledge, trade secrets and any other type of protected property in connection with the service which we own or possess;
    4. “RIC Act” means the Regulation of Interception of Communications and Provision of Communication Related Information Act 70 of 2002;
    5. “Service” means co-opTV’s website (or any interaction with the website), content, content syndicated from co-opTV’s curators, co-opTV’s products, co-opTV’s software and/or co-opTV’s services which are accessible through the website;
    6. “trademarks” means those trademarks we own and any other slogans, designs, logos, style names, tag lines and slogans which we own or have the right to use;
    7. “website” means www.co-opTV.com and each and every website co-opTV owns, hosts, operates or administers, including all sub-pages, parts or elements thereof, excluding links to external websites;
    8. “ECTA” refers to the Electronic Communications and Transactions Act 25 of 2002;
    9. “the user” means you and all visitors to the Service and any other person seeking to interact with the Service;
    10. “co-opTV”, refers to a production of LRP CC, a proprietary of the service or website;
    11. “co-op” refers to any channel provided as a service on the website;
    12. “curator” is the third party entity, producer or director responsible for the content of a co-op;

    1. Terms of use

      The user agrees that these terms of use shall be governed by and construed and interpreted in accordance with the laws of the Republic of South Africa.

      co-opTV is made available on condition that the user accept these terms of use as they are and make themselves aware of any updates and changes at the time of use. These terms of use are a binding contract between themselves and co-opTV, and they should be read thoroughly, understood and agreed upon. We offer the Service to the user subject to these terms of use. co-opTV reserves the right to add new services and modify or even discontinue existing services.

      If the user access and/or use the Service in any way, we will take that to mean the user have read and understand these terms of use, as they exist when the user access and/or use the Service, and agree to them. Do not use the Service or any of the services if the user does not agree with any provision contained in these terms of use.

      We reserve the right, and the user agrees that we may, in our sole discretion amend these terms of use at any time, in any way. These amendments shall come into effect immediately and automatically.

      It is your responsibility to review these terms of use regularly and to ensure that the user agrees with any amendments to these terms of use. The user may no longer make use of the website or the services If the user do not agree with any amendments to these terms of use. Only we may amend these terms of use.

      If the user is a person barred from receiving the Service under the laws of the Republic of South Africa or other countries, the user may not use the Service. In order to use the Service or access the content the user represent and warrant that the user are of full legal age, or are emancipated or have your guardian’s consent to enter into a contract being these terms of use.

      It remains solely your responsibility not to access any content that may be inappropriate.

      Any illegal, unlawful or immoral use of this service or its content is prohibited by these terms of use.

      No framing or bordering of any part or page of this Website is allowed without prior written consent from co-opTV. Third party websites may not imply that co-opTV is in any way endorsing the products or services offered on such website. By accessing this service, the user agrees to comply with all local laws, rules and regulations regarding online conduct.

      Should the user engage in any one of the above practices, which shall be determined in co-opTV's sole discretion (and which decision shall be final), then co-opTV shall be entitled, without prejudice to any other rights it may have, to bill the user for any costs we incur, including (without being limited to) bandwidth, administration costs, downtime, usage of co-opTV’s name or registered domain names and CPU cycles; and/or notwithstanding co-opTV’s privacy policy below, disclose any information relating to the user, whether public or personal, to all persons affected by your actions.

    2. Privacy policy and Communications

      co-opTV understands the importance of privacy to our clients. co-opTV has adopted this Privacy Policy as we recognise the right of our clients and others to keep their personal information private. This Privacy Policy covers co-opTV's treatment of personally identifiable information that we collect or hold. Sites that are linked to our site may have different policies; please review the privacy policy notices on those sites for details.

      Personal information collected by co-opTV may include your name, current address, phone numbers, e-mail address and any other information relevant to providing the user with the service the user request. Personal information is collected through our site when the user knowingly and voluntarily submits information. It is our intention that this policy will protect your personal information consistent with any applicable privacy laws of South Africa.

      The Service is provided “as is” without any representations or warranties, express or implied. co-opTV makes no representations or warranties in relation to this website or the information and materials provided on this website. Your use of the services is at your own risk and the user indemnifies co-opTV, its directors, officers, employees any third party curators from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from the user’s use of and access to the co-opTV service and/or Website, your violation of any term of these Terms of Service, your violation of any third party right, including without limitation any copyright, property, or privacy right.

      To the fullest extent permitted by law, co-opTV, its channels (Co-ops) its directors, employees, and third party curators (including as a result of co-opTV’s negligent acts or any other circumstance), disclaim all warranties, express or implied, in connection with the website and your use thereof. co-opTV makes no warranties or representations about the accuracy or completeness of this site's content or the content of any sites linked to this site and assumes no liability or responsibility for any content, damages, injury, of any nature whatsoever, resulting from your access to and use of the co-opTV service, any unauthorized access to or use of our host server and/or any and all personal information and/or financial information stored therein, any interruption or cessation of transmission of our service, any bugs, viruses, Trojan horses, or the like which may be transmitted to or through our website. co-opTV does not warrant, endorse, guarantee, or assume responsibility in any way for any product or service advertised or offered by a third party through the co-opTV website or any hyperlinked website or featured in any banner or other advertising.

    4. Dealings with Third Parties

      Any links from the Website to a third party website does not amount to an endorsement or guarantee of the third party website; and co-opTV shall not be held directly or indirectly accountable as result of the contents or lack of contents on a linked third party website. co-opTV also does not accept responsibility or liability for any third party practices on third party websites, and advises users to consult third party websites' terms and conditions in this regard.

    6. General

      The user agrees to be bound by these terms of service and that the co-opTV Website shall be deemed solely based in South Africa. The laws of the Republic of South Africa shall govern these Terms of Service. The service is controlled and operated by co-opTV, which is a production of LRP CC 2009/222070/23, a legal entity incorporated in terms of the laws of the Republic of South Africa and therefore South African law and the jurisdiction of the South African Courts shall govern any action or claim that may arise. These Terms of Use and any other legal notices published by co-opTV on the Website, shall constitute the entire agreement between you and co-opTV concerning the co-opTV Website. If a court of competent jurisdiction deems any provision of these Terms of Use invalid, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Service, which shall remain in full force and effect. No waiver of any term of this these Terms of Service shall be deemed a further or continuing waiver of such term or any other term, and co-opTV's failure to assert any right or provision under these Terms of Use shall not constitute a waiver of such right or provision. co-opTV reserves the right to amend these Terms of Use at any time and without notice, and it is your responsibility to review these Terms of Use for any changes. Your use of the co-opTV Website following any amendment of these Terms of Use will signify your assent to and acceptance of its revised terms. You and co-opTV agree that any cause of action arising out of or related to the co-opTV website must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.
